New York Releases Retail Worker Safety Resources: What Employers Need to Know

The landscape of retail employment in New York State is evolving. With the introduction of the Retail Worker Safety Act, employers are now tasked with implementing specific measures to enhance workplace safety and reduce the risk of violence. Understanding and complying with these requirements is crucial for maintaining a safe environment for both employees and customers.
Key Requirements of the Retail Worker Safety Act (Effective June 2, 2025)
Applicability: The Act applies to all retail employers in New York State with 10 or more employees. Retail establishments are defined as stores that sell goods directly to the public, excluding businesses primarily selling food for on-site consumption, such as restaurants.
Workplace Violence Prevention Policy: Employers must develop and implement a written Retail Workplace Violence Prevention Policy. This policy should outline strategies to mitigate risks and procedures for responding to incidents. The NYSDOL provides a model policy that can be adapted to fit your business needs.
Employee Training: Upon hire and every 1-2 years, depending on headcount, all employees must receive training on the workplace violence prevention policy. This training should cover recognizing potential hazards, reporting procedures, and response strategies. The NYSDOL offers a model training program to assist employers in meeting this requirement.
Language Accessibility: Employers are required to provide the policy and training materials in English and in the primary language of each employee, provided the NYSDOL has made translations available in that language. If translations are not available, materials may be provided in English.
Silent Response Button (Effective January 1, 2027): Retail employers with 500 or more employees must equip employees with a silent response button to request immediate assistance during emergencies. Training on the use of this device is also mandated.
